Do you know what it means to delegate electronic signatures? Let’s take it one step at a time.<\/p>\r\n

As its own meaning indicates, the word “delegate<\/strong><\/em>“ is to give a person to another person the power to represent him and exercise it on his behalf.<\/strong> Delegating is essential if you want to improve the use of your time. In most cases, not delegating effectively can reduce the development of the tasks<\/strong> that require your attention; on the other hand, delegating effectively is multiplying achievements.<\/p>\r\n\r\n\r\n\r\n\r\n\r\n

As you have seen, the term ‘delegate’ is very useful, especially if we are talking about delegating electronic signatures.<\/p>\r\n

For example, imagine that you have a signature agenda in an electronic signature holder, an application very similar to a traditional signature holder. In this case, it would be quite useful to be able to delegate sorting, prioritizing or reviewing tasks to another person with their own user. You would only have to access your signature tray and carry out the operations using your electronic certificate in a single operation, similar to how it is done in a conventional signature holder where documents are delivered in orderly order for signature.<\/p>\r\n\r\n\r\n\r\n

In addition, we could delegate the signing of these documents when we were absent or needed to do so.<\/p>\r\n\r\n\r\n\r\n

En el caso de las Administraciones P\u00fablicas, la Ley 30\/1992<\/strong> que establece y regula las bases del r\u00e9gimen jur\u00eddico, el procedimiento administrativo com\u00fan y el sistema de responsabilidad de las Administraciones P\u00fablicas cuenta con un Art\u00edculo, en concreto el 16, dedicado a La Delegaci\u00f3n de la firma:<\/p>\r\n\r\n\r\n\r\n

“Art\u00edculo 16. Delegaci\u00f3n de firma<\/em><\/h3>\r\n
    \r\n
  1. Los titulares de los \u00f3rganos administrativos podr\u00e1n, en materia de su propia competencia, delegar la firma de sus resoluciones y actos administrativos a los titulares de los \u00f3rganos o unidades administrativas que de ellos dependan, dentro de los l\u00edmites se\u00f1alados en el art\u00edculo 13.<\/em><\/li>\r\n
  2. La delegaci\u00f3n de firma no alterar\u00e1 la competencia del \u00f3rgano delegante y para su validez no ser\u00e1 necesaria su publicaci\u00f3n.<\/em><\/li>\r\n
  3. En las resoluciones y actos que se firmen por delegaci\u00f3n se har\u00e1 constar la autoridad de procedencia.<\/em><\/li>\r\n
  4. No cabr\u00e1 la delegaci\u00f3n de firma en las resoluciones de car\u00e1cter sancionador.”<\/em><\/li>\r\n<\/ol>\r\n

    Por lo tanto y, teniendo en cuenta que la firma electr\u00f3nica tiene la misma validez legal que la firma manuscrita<\/strong> seg\u00fan la Ley 59\/2003 de Firma Electr\u00f3nica, <\/strong>podr\u00edamos delegar incluso nuestra firma en nuestro portafirmas electr\u00f3nico.<\/p>\r\n
