Are you a self-employed or SME owner, and you are tired of reading about the measures brought by the Create and Grow Law and not knowing how it affects you? You are not the only one. Although the regulation will bring new measures for SMEs and freelancers, such as the obligation to issue electronic invoices, there is a great lack of knowledge about what the new regulation implies, what benefits it offers and what are the best tips or solutions for freelancers or SMEs to follow.
If you belong to one of the two groups mentioned above, this article is of interest to you. Today, we will tell you the main details you should know about the Create and Grow and VeriFactu Law. Read on!
Electronic invoicing, a bit of history
One of the references we have when we talk about electronic signatures is the electronic invoice, since it has been used since the beginning of the first uses of electronic signatures or digitalization processes.
However, the electronic invoicing system has changed a lot since we started talking about it and, in order to better understand the current situation, it is useful to know this evolution. The following are the main milestones in the field of electronic invoicing.
Creation of FACe
FACe was created to centralize general electronic invoicing points for all those entities that have to invoice the Public Administrations. Since its implementation, any company that has to invoice a Public Administration must do so with an invoice in Facturae format and through FACe.
Immediate Supply of Information System with the Tax Agency (SII)
The entry into force of this system on July 1, 2017 obliged all companies with a turnover of more than 6 million euros per year to communicate to the AEAT all invoices issued and received within a maximum period of 4 calendar days. The SII has a triple objective:
- Simplify compliance
- Reduce costs with automation
- Improve fiscal control.
Changes in the invoicing of self-employed and SMEs
Although many taxpayers who are affected by it are not very aware, in the coming months VERIFACTU (RD 1007/23) and RD of B2B INVOICING (Create and Grow Law) will come into force. And they will affect small taxpayers the most, since large taxpayers were already affected by the SII.
What you should know about VeriFactu
The most important thing you should know about VeriFactu is:
- Scope of application: Companies and Self-Employed with a turnover of less than 6 million euros per year.
- Purpose: Fight against fraud (together with the Anti-Fraud Law) and tax evasion, boost the digitalization of
- companies and improve the assistance services provided by the Tax Agency to taxpayers.
- What I need to comply:
- Generation of discharge billing record.
Remission of invoicing records.
Integrity and unalterability of billing records.
Traceability of billing records.
Preservation, accessibility and readability of billing records.
Event logging.
Adding a fingerprint or “hash” to the billing records of registration and cancellation.
