The legal framework for the regulation of the electronic signature in Venezuela is the Law 1204, of December 13, 2000. This regulation recognizes the legal validity of the electronic signature that meets the requirements to be specified below. Unlike the legislation of other countries, in this case the lack of compliance with these requirements will mean the invalidity of the electronic signature. The requirements to be met are:

  1. Guarantee that the data used for its generation can only be used once, as well as ensuring its confidentiality
  2. Offering enough security so it cannot be forged with the existing technology
  3. Not altering the integrity of the Data Message

Thus, the advanced electronic signature can be considered as the e-signature, but in Venezuela there is no equivalent of a simple electronic signature.
